1. Description of Flagship

Flagship is an AI-powered web application that enables you to generate professional device mockups by combining images you upload with AI-generated props and environments. You upload a screenshot or design, select a target device, describe a scene, and Flagship produces a polished mockup suitable for marketing materials, portfolios, presentations, and other professional uses.

Flagship uses third-party AI image generation services to produce mockup outputs. Generation results may vary and are not guaranteed to match your exact expectations.

2. Account and Authentication

To use Flagship, you must create an account by authenticating through Google OAuth. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

Your Flagship account is linked to your Tortuga account. Deleting either account may affect your access to the other.

3. Subscription and Pricing

3.1 Plan

Flagship is available as a paid subscription at $16 per month. Your subscription includes up to 30 mockup generations per billing cycle. Each generation produces two variations, giving you up to 60 total mockup outputs per billing cycle.

3.2 Billing

• Subscriptions are billed monthly in advance through our third-party payment processor, Stripe.
• Subscriptions renew automatically unless you cancel before the renewal date.
• You may cancel at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.
• We may change pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new pricing.

3.3 Usage Limits

• Your subscription includes a monthly allowance of 30 mockup generations per billing cycle. Each generation produces two variations, for a total of up to 60 mockup outputs.
• Usage resets at the start of each billing cycle (not the calendar month).
• Unused mockup generations do not roll over to the next billing cycle.
• Failed generations (due to API errors, timeouts, or content policy issues) do not count against your monthly allowance.
• If you reach your monthly limit, you will be unable to generate additional mockups until your next billing cycle begins.

4. Your Content

4.1 Uploaded Content

You retain ownership of all images, screenshots, and other content you upload to Flagship ("Your Content"). By uploading content, you grant Tortuga a non-exclusive, worldwide, royalty-free license to use, process, and transmit Your Content solely as necessary to provide the Flagship service to you, including transmitting Your Content to our third-party AI generation provider for the purpose of producing your requested mockup.

You represent and warrant that you have all necessary rights to upload and use Your Content, and that Your Content does not infringe upon any third party's intellectual property, privacy, or other rights.

4.2 Generated Mockups

Mockups generated by Flagship using your uploaded content and AI-generated elements ("Generated Mockups") are provided to you for your commercial and personal use. You may use Generated Mockups for marketing materials, app store listings, social media, presentations, portfolios, and similar purposes.

Due to the nature of AI-generated content, Tortuga does not guarantee that Generated Mockups are free from similarities to other content or that they will qualify for copyright protection in all jurisdictions. You use Generated Mockups at your own risk with respect to intellectual property claims.

4.3 Prohibited Content

You may not upload or use Flagship to generate content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Infringes upon any third party's intellectual property rights, including copyrighted images, trademarks, or trade dress.
• Contains sexually explicit material, depictions of minors, or content that exploits or endangers children.
• Promotes violence, discrimination, or hatred against any individual or group.
• Violates any applicable law or regulation.

We reserve the right to remove any content and suspend or terminate your account if you violate these restrictions.

5. Data Retention

Your uploaded images and generated mockups are subject to the following retention policies:

• User-uploaded images are retained for 30 days from the date of upload.
• Generated mockups are retained for 30 days from the date of creation.
• Deleted mockups are soft-deleted and retained for an additional 30 days, during which they may be restorable via support. After this period, they are permanently removed.
• An automated cleanup process runs daily to purge expired files.

You are responsible for downloading any mockups you wish to keep before they expire. Tortuga is not responsible for content lost after the retention period.

6. AI Generation Disclaimer

Flagship relies on third-party AI image generation services to produce mockup environments and props. You acknowledge and agree that:

• AI-generated results may vary in quality, accuracy, and consistency.
• Generation may fail due to API errors, service outages, content policy filtering, or other technical issues beyond our control.
• We do not guarantee specific generation outcomes, turnaround times, or output quality.
• AI-generated elements in your mockups are produced algorithmically and may occasionally contain artifacts, inconsistencies, or unexpected results.
• We may change or update the underlying AI generation model or provider at any time to improve the service.

7. Acceptable Use

In addition to the acceptable use provisions in the General Terms, you agree not to:

• Use Flagship to generate mockups that impersonate or misrepresent the products, services, or branding of any third party.
• Use automated tools, scripts, or bots to generate mockups in bulk or to circumvent usage limits.
• Attempt to reverse-engineer, extract, or replicate the AI generation pipeline or underlying models.
• Resell, sublicense, or redistribute access to Flagship or its generation capabilities without our prior written consent.
• Use Flagship in any manner that could disable, overburden, or impair our servers or infrastructure.

8. Intellectual Property

All content, design, code, AI models, interfaces, and other materials comprising Flagship are owned by Tortuga or our licensors and are protected by intellectual property laws. These Terms do not grant you any ownership rights in Flagship or its underlying technology.

The Flagship name, logo, and associated branding are trademarks of Tortuga AI, Inc. You may not use our trademarks without our prior written permission.

9. Privacy

Your use of Flagship is also governed by our Flagship Privacy Policy, which describes how we collect, use, and share your information, including how your uploaded images and prompts are processed. The Privacy Policy is incorporated into these Terms by reference.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, TORTUGA DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT FLAGSHIP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI-GENERATED OUTPUTS WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TORTUGA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF FLAGSHIP, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM AI GENERATION FAILURES, CONTENT LOSS AFTER RETENTION PERIODS, OR RELIANCE ON GENERATED OUTPUTS.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO FLAGSHIP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR FLAGSHIP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Termination

You may stop using Flagship and cancel your subscription at any time. We may suspend or terminate your access at our discretion, with or without notice, for conduct that we believe violates these Flagship Terms, the General Terms, or is harmful to other users, us, or third parties.

Upon termination, your right to use Flagship ceases immediately. Your uploaded content and generated mockups will be retained according to our standard data retention policies and then permanently deleted. Sections 4.2, 6, 8, 10, 11, and 14 will survive termination.

13. Changes to These Terms

We may update these Flagship Terms from time to time. We will notify you of material changes by posting the updated terms on our website or by email. Your continued use of Flagship after the changes take effect constitutes your acceptance of the updated terms. You can always check the effective date at the top of this document.

14. Governing Law and Dispute Resolution

These Flagship Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Dispute resolution is governed by the General Terms.
